How is feed regulated in China?
• Feed is regulated by two governmental agencies in China:
1. the Department of Animal Husbandry under the Ministry of Agriculture (MOA)
2. the National Feed Management Office under the Ministry of Agriculture (MOA), and
3. the Department for Supervision of Animal and Plant Quarantine under General Administration of Quality Supervision, Inspection and Quarantine (AQSIQ) of the People's Republic of China. 
• The MOA is responsible for managing catalogues of feed materials, feed additives, pet food, and “medical feed additives” (primarily antibiotics). 
 NOTE: MOA is also responsible for both registering production facilities within China, as well as registering those facilities to produce specific products in China.
• AQSIQ is responsible for approving market access applications for feed ingredients and additives (by category or product) to be exported to China for the first time and for registering all overseas feed ingredient and additive manufacturing facilities that export to China.
• Manufacturers looking to export products to China for the first time must complete both of these steps before they can ship their products to China. These requirements are laid out in Decree 118, which came into effect September 2009. 
 
What ingredients are approved for use in animal feed in China?
• Only those substances included in the catalogues of feed ingredients and feed additives are permitted to be used in animal feed production. Please contact us for more information about this.
 
How do I register my feed product or renew my registration for export to China?
• The MOA is responsible for issuing import registration licenses for feed ingredients and additives and pet food.
• The Regulation on Feed and Feed Additive Import Registration is covered under Ministry of Agriculture 2014 Decree No. 2. (MOA 2014 Decree No. 2 (unofficial translation))
• Under MOA regulations, the following feed ingredients and additives are subject to import registration licensing: pre-mixture, concentrate, compound, supplementary feed, “single feed ingredients”, and feed additives.
• Overseas manufacturing facilities wishing to export these products to China are required to apply for an import registration license through a China-based agent.

o Application process:
˗ The overseas manufacturing facility must designate a China-based agent and work with them to apply to the MOA for an import registration license.
˗ The MOA must evaluate the application within 20 working days.
˗ The agent must deliver samples of the product, per requirements, to an MOA designated laboratory.
˗ The laboratory must notify the MOA of the test results within three months and send a copy to the facility’s agent. 
˗ The MOA must prepare the license and notify the agent to collect the license.
 
 
How do I register my facility for export to China?

Background
• AQSIQ enacted and implemented Decree 118 in 2009. Decree 118 requires the registration of all feed, feed ingredient and pet food facilities exporting to China. 
• AQSIQ Decree 118 (unofficial translation): Please note that this document is merely the regulation and does not contain information on implementation. Implementation/protocol requirements of this decree are ongoing for some feed product categories, while others have been negotiated since publication of the decree. 
• Decree 118 has been implemented in a phased-in approach. 
• Traditionally traded products (TTP), in general, were allowed to continue being exported to China until AQSIQ completes its risk review of a given category of products. Traditionally traded products are products that are, as their title suggests, traditionally imported into China.
• The outcome of the risk review is an AQSIQ list of approved suppliers and an export protocol agreed upon by the local competent authority and AQSIQ. Any facilities that have qualified for export to China as a TTP that are not on the AQSIQ approved suppliers list will no longer be eligible to export to China.
 
o Application process:
1.The competent quarantine authority of the exporting country shall, according to the trade interest, submit an official application in written form to General Administration of Quality Supervision, Inspection and Quarantine of the People’s Republic of China(AQSIQ)for exporting agricultural products to China with the its name, variety , use and information of importers and exporters.
2.AQSIQ will, according to the application, deliver a questionnaire concerning the Import Risk Analysis (IRA) to the exporting country for reply.
3.After receiving the reply to the questionnaire, AQSIQ will organize the relevant specialist to initiate IRA process.
If necessary, AQSIQ will ask the exporting country for more information during the evaluation period;
Based on the assessment of the above information, AQSIQ will decide whether it is necessary to send a specialist group to the exporting country to have on-the-spot inspection.
4.After finishing the IRA, AQSIQ will take account of whether or not to submit a draft of quarantine protocol or sanitary requirements for the product to be imported from the country to China, which will be discussed by both sides.
5.After having reached agreement on the protocol or sanitary requirement, the trade of this product will be commenced according to the requirements specified in the protocol.
